Buy & Win Proton X70 (“Campaign”) is organised by Saudagaar Asia Sdn. Bhd. (Registration No.1104930-U) (“Choco Albab”) and shall be subject to the Terms and Conditions herein. By participating in respect of this Campaign, Eligible Participants (as defined below) hereby expressly agree to be bound by these Terms & Conditions and any decisions made by Choco Albab in respect of the Campaign shall be final, conclusive and binding
1. Eligibility:
1.1. Participants must make a minimum purchase of RM29.90 worth of Choco Albab’s products, including items from the Chocotub, cookies, or chocolate drink range, to participate.
1.2. Participants will receive 1 point of entry for every RM29.90 in a single receipts.
1.3. Participants are allowed to have as many points of entry throughout the campaign period.
1.4. Participants MUST Follow and Like, ALL Choco Albab Official Social Media (Instagram, Facebook and Tiktok) to be selected as the winner. You may find the link to the official social media here,
2. The competition is open to Malaysian citizens aged 18 years and above ONLY.
3. Choco Albab reserve the right to amend the Campaign Period or Terms & Conditions for any reason whatsoever.
4. Entry Process:
4.1. Participants must scan the QR code from the receipt and submit their completed details.
4.2. Participants should keep the proof of purchase to claim the prize.
5. Entry Period:
5.1. The competition is valid for purchases made during Karnival Jom Heboh 2024 at Choco Albab booth only.
5.2. The campaign starts from 3rd May 2024 until 3rd November 2024.
6. The draw will be carried out within 30 business days after the end of the Campaign Period or any other period as may be determined by Choco Albab.
7. Prizes:
7.1. The grand prize for the campaign is Proton X70.
7.2. Where applicable, prize is awarded randomly based on a lucky draw mechanism with proprietary operational details that will not be revealed to Eligible Participants or the public at large.
7.3. Participation in the Campaign shall be construed as consent to the usage of said randomizer program and explicit acceptance of any and all Campaign results it may produce.
7.4. Choco Albab reserves the right to substitute the Prize with any other item(s) of similar market value without prior notice.
7.5. Prize is not transferable nor exchangeable and will only be issued to the winner as verified by Choco Albab.
7.6. Choco Albab reserves the right to request for documentation or written proof of identification, age, and place of residence of any or all winners prior to the collection of the Prize for verification to ensure compliance with Terms and Conditions
7.7. To the fullest extent permitted by law, Choco Albab expressly excludes and disclaims any representations, warranties, or endorsements, express or implied, written or oral, including but not limited to any warranty of quality, merchantability or fitness for a particular purpose in respect of the prize.
7.8. Prize presented on any materials (if any) is for display purpose only and does not depict the actual prize.
8. Winner Announcement and Prize Collection:
8.1. Winner will be selected based on a method determined by Choco Albab after considering the eligibility criteria of participants.
8.2. Choco Albab has the discretion to review the criteria, eligibility, entry requirement, and frequency of the draw from time to time as Choco Albab considers appropriate with twenty-one (21) calendar days prior notice
8.3. The winner can only win one prize.
8.4. Winner will be officially notified by Choco Albab. Winner must redeem his/her prize by the date stipulated in the official letter, failing which, his/her prize will be forfeited. No replacement or appeal will be entertained.
8.5. The prize given is on an “As Is” basis and is non-transferable, non-exchangeable, non-redeemable for cash, in part or in full and are subject to the Terms & Conditions stated herein. No request for change of prize, or any parts, or appearances or accessories will be entertained.
8.6. Winner might be required to appear in person at Choco Albab Headquarters or personally redeem the prize from the supplier. If such occasions arise, the winner will have to make his/her own arrangement and all expenses incurred will be borne by the winner himself/herself.
8.7. Fulfillment of the prize will be executed within 90 business days of the following month from the Winner selection period or such date as may be determined by Choco Albab in its discretion.
8.8. In the event that the winner dies after the notification of the prize winner, the heirs,legal representative, and/or administrator of the deceased may claim the prize within three (3) months from the date of the notification, failing which, Choco Albab has the discretion to deal with the prize including to re- draw and/or elect any other person as the prize winner whichever Choco Albab considers appropriate.
9. Responsibilities:
9.1. Winner is responsible for any ownership transfer costs and registration of prizes.
9.2. Choco Albab will not be held responsible for the condition of any prizes awarded.
9.3. Choco Albab accepts no responsibility for any tax responsibilities that may arise from the prizes or the use thereof. Any tax filing obligation or tax payment (if any) due to any tax authority as a result of receipt of the prize remains the sole responsibility of the Prize Winner.
9.4. It is the responsibility of the Prize Winner to seek independent tax advice on the possible tax responsibilities to their financial situations.
9.5. Choco Albab is not the supplier of the prize and makes no warranty or representation as to the quality, merchantability and/or the fitness for purpose of the prize provided and shall not be responsible for any defect or any other loss or damage that may be suffered in connection with the prize.
9.6. Any dispute over the prize provided by the merchant should be resolved directly between Winner and the merchants.
9.7. The Grand Prize shall exclude car/vehicle registration fees, road tax, insurance and delivery fees. Winner shall be responsible for any additional costs, duties, taxes and/or other incidental expenses, which may be incurred as a result of and/or related to their acceptance of the Grand Prize.
9.8. Grand Prize Winner is required on their own accord and expenses to register with the Road Transport Department (Jabatan Pengangkutan Jalan) before the Grand Prize giving ceremony in which the date and venue will be determined by Choco Albab at its own discretion.
9.9. All cost, fees and/or expenses incurred or to be incurred by the Grand Prize Winners in relation to the Campaign and/or claim the Grand Prize, which shall include but not limited to the cost of the transportations, accommodation, meals, personal costs and/or other costs, are the sole responsibility of the Grand Prize Winner.
9.10. In the event the Grand Prize winner is unable to attend the Grand Prize giving ceremony at the Choco Albab headquarters, he/she will automatically be disqualified and no compensation or arrangement will be made after the Grand Prize giving ceremony.
9.11. In the event that the authorized dealer is unable to supply the same model as described herein to Choco Albab due to reasons which include, but are not limited to manufacture(s) recall or damaged/lost/stolen during storage and delivery, Choco Albab reserves the right to substitute the Grand Prize with another model of like or similar value as its sole discretion, with twenty-one (21) days prior notice by way of posting on the Choco Albab Website at www.chocoalbab.asia or any other methods as it deems fit.
9.12. Choco Albab gives no assurance or satisfaction guarantee in regards to the Grand Prize.
9.13. It will be a direct arrangement/settlement between the Winner and the authorized dealer without any resource to Choco Albab for any dispute in relation to quality or warranty of the Grand Prize or any terms and conditions in respect thereof.
10. Cancellation and Disputes:
10.1. Choco Albab may disqualify/reject any Eligible Participants who does not comply with the terms and conditions stated herein and/or are found or suspected to be tampering with the Campaign and/or its process or the operations of this Campaign which includes fraudulent activities involving any act of deceit and/or deception and/or cheating with regards to the Campaign and/or activities or other activities harmful to the Campaign and/or the participant has been disqualified from previous Campaigns organized by ChocoAlbab.
10.2. Choco Albab reserves the right to reject any participation without assigning any reasons.
10.3. In the event of any dispute, Choco Albab’s decision shall be final and binding.
10.4. Choco Albab reserves the right to withdraw, cancel, suspend, extend or terminate this Campaign earlier in whole or in part and reserves the right to modify any of the terms and conditions contained herein, from time to time by giving at least minimum of twenty-one (21) days (“day” shall have the same meaning as calendar day) prior notice thereof, the notice of which shall be posted through Choco Albab website (www.chocoalbab.asia) or through any other channel determined appropriate by Choco Albab. It shall be the responsibility of the eligible participant to be informed of or otherwise seek out any such notice validly posted.
10.5. Choco Albab shall not be liable for any default of its obligation under this Campaign due to any force majeure events which include but not limited to acts of God, civil commotion, acts of war, strike, riot, lockout, industrial action, fire, flood, drought, storm, epidemic and pandemic or any events and circumstances of whatever nature beyond the reasonable control of Choco Albab.
11. Consent:
11.1. By participating in this Campaign, Eligible Participants agree to be bound by the Terms and Conditions herein and agree and consent to allow his/her personal data being collected, processed and used by Choco Albab in accordance with the Choco Albab Privacy Statement, which may be viewed on www.chocoalbab.asia (“Choco Albab Privacy Statement”).
11.2. In addition, and without prejudice to the terms in Choco Albab’s Privacy Statement, Eligible Participants agree and consent to his/her personal data or information being collected, processed and used by Choco Albab for: a) the purposes of the Campaign; and b) marketing and promotional activities conducted by Choco Albab, including but not limited to any form of advertising or publicity media and materials such as audio and/or visual recordings published through newspapers, television networks, radio stations or online and digital media and on the Internet. Marketing and promotion activities include without limitation the use and/or publication of any details provided in and/or in connection to the entries, interviews material as well responses and related photographs. In this regard, Eligible Participants agree to co-operate and participate in all advertising and publicity activities of Choco Albab in relation to the Campaign.
12. General:
12.1. Choco Albab reserves the right to amend these Terms and Conditions at any time without prior notice.
12.2. These Terms and Conditions prevail over any other promotional materials.
12.3. Employees of Choco Albab (Saudagaar Asia Sdn. Bhd.) and its family members are not allowed to participate in this Campaign.
12.4. Choco Albab shall not be responsible or held liable in respect of technical failures of any kind whatsoever, intervention, interruptions, and/or electronic or human errors in the administration and/or processing of the transaction or registration performed via the QR code provided the same is not caused by Choco Albab.
12.5. By participating in this Campaign, Eligible Participants agree to access the Choco Albab website on a regular basis to view the terms and conditions herein and seek clarification from Choco Albab should any of the Terms & Conditions be not fully understood.
12.6. These Terms & Conditions shall be governed by the Laws of Malaysia and subject to the exclusive jurisdiction of the Courts of Malaysia.
